This Web Hosting Agreement is between Farihost and the person or persons who use our website hosting and domain service. Please read carefully to ensure you understand our terms before purchasing any of our products or services.
Farihost agrees to provide the services stated for the price agreed at any given time. We do not mislead customers with hidden costs unlike many other web hosting companies.
All customers are responsible for monitoring their storage space and bandwidth transfer each month. Customers who go over the limit of their account will be sent an email with the option to either upgrade their account or reduce storage usage. We hold the right to ban accounts for continuous problems. If customers sign up for an account and cancel it within the first month, they will still be charged for the full first month.
Renewal notices are emailed three days before the actual renewal date in your account. All accounts are set up on a pre-pay basis. If payment is not received within 7 days, a $5 fee will be added. Farihost reserves the right to change prices at any time unless other terms have been agreed upon.
Any account not brought current within one week of email notice may be subject to suspension. You are responsible for all fees owed on the account from the time it was established until you notify Farihost to request termination of services.
All annual payments are non-refundable once the 30-day money-back guarantee has passed. Monthly and annual payments are non-refundable if your account does not follow our terms of service or acceptable usage policy.
Customers acknowledge that the amount of services purchased is based on the customer’s agreement to pay the fee for the initial term or renewal term.
Any attempt to undermine or cause harm to a server or customer of Farihost is strictly prohibited.
Farihost will strongly react to any use or attempted use of an Internet account or computer without the owner’s authorization. Such attempts include Internet scamming, password theft, security hole scanning, and similar activities.
Any unauthorized use of accounts or computers by you may result in warnings, account suspension, cancellation, or civil or criminal legal action depending on the seriousness of the attack.
Farihost has the right to discontinue service or deny access to anyone who violates our policies or terms and conditions without warning or prior notice. No refunds will be made if account termination is due to violation of these terms.
You may not run IRC, bots, or clients on shared servers. Unacceptable uses include, but are not limited to, bulk emailing, unsolicited emailing, newsgroup spamming, upload scripts, pornographic content, illegal content, copyright infringement, trademark infringement, warez sites, cracks, software serial numbers, proxy-relaying, link farming, spamdexing, and anything else determined by Farihost to be unacceptable use of our services.
All web applications that are out of date and actively being exploited may be shut down immediately without prior notice. You are responsible for evaluating your web-based applications and scripts regularly to ensure their security and orderliness.
Farihost will be the sole arbiter as to what constitutes a violation of this provision. You are responsible for monitoring your disk space usage. If you need extra disk space, please contact our staff or upgrade your hosting plan from inside your Farihost client account.
The intention of Farihost is to provide bandwidth to transfer web documents, not to provide an offsite storage area for electronic files. If you violate this condition, you will be notified and given 48 hours to remedy the problem. Failure to do so may result in charges for overages.
Traffic will go unmonitored until you reach the quota allocated to your specific plan. Farihost will be the sole arbiter as to what constitutes a violation of this provision.
Customers agree to use our services under the Acceptable Usage Policy, which is incorporated into this agreement. Customers agree that Farihost holds the right to change its AUP at any time to meet web hosting standards and laws.
Customer represents and warrants that the information provided to Farihost for establishing and maintaining the service is accurate. If Customer is an individual, Customer represents and warrants that he or she is at least 18 years of age.
Unsolicited commercial advertisements, also known as spam, are not allowed in email and may result in account cancellation. Farihost takes a zero-tolerance approach to spam originating from its servers or spam advertising of domains hosted within our network.
Activities not allowed include bulk mailing of commercial advertising, informational announcements, charity requests, petitions, political or religious tracts unless explicitly requested, forged or altered email headers, mail bombing, newsgroup spamming, harassment, or intimidation by email.
If you use another provider to promote a website hosted by or through Farihost, the same spam policy applies as if the spam were sent through our servers.
This 99.99% uptime guarantee applies to any customer in good financial standing with Farihost at the time of a service outage.
Farihost endeavors to have the content of your website available for HTTP access worldwide 99.99% of the time. Network downtime is defined as 100% packet loss from Farihost to its backbone providers.
In the event that your website is unavailable, Farihost may credit the following month’s service fee according to the applicable service level terms.
Credit shall not be provided for scheduled maintenance, customer behavior, failure of customer equipment or applications, circumstances beyond Farihost’s reasonable control, third-party failures, DNS propagation, domain registration or transfer delays, or violations of Farihost’s Terms & Conditions and AUP.
Farihost provides technical support within its area of expertise, including assistance, troubleshooting, and debugging of the cPanel control panel interface, servers within our responsibility, and other hosting-related issues.
Although we do our best to help with scripts, templates, and programming languages, Farihost is not obligated to install new application modules, templates, or programming languages, or provide assistance for errors caused by applications modified by you.
Each shared web hosting account comes with its own CGI-BIN. You are free to use CGI scripts, however we reserve the right to disable any CGI script that affects normal shared server operation without prior notice.
Customer agrees to indemnify and hold harmless Farihost, its affiliates, officers, directors, agents, and employees from and against any claims, liabilities, damages, penalties, fines, expenses, or disbursements arising out of or related to the use of Customer’s services in violation of applicable law or the AUP.
You agree to defend, indemnify, and hold harmless Farihost against liabilities arising from injury to person or property, material supplied by the customer infringing third-party rights, copyright infringement, or defective products sold through Farihost’s server.
Farihost does not warrant or represent that services will be uninterrupted, error-free, or completely secure. To the extent permitted by applicable law, all services are provided on an “as is” basis.
Neither party shall be liable to the other for lost profits or any indirect, special, incidental, consequential, or punitive loss or damage arising in connection with this agreement.
The maximum aggregate liability of Farihost and its employees, agents, or affiliates shall not exceed the amount payable by the customer for three months of service.
Farihost may suspend services without notice if it reasonably believes the services are being used in violation of the AUP, if Customer fails to cooperate with an investigation, if suspension is necessary to protect the network or other customers, or if requested by law enforcement or a regulatory agency.
If you break our terms of service or acceptable usage policy, we hold the right to cancel any services. We do not refund accounts that break our terms of service or acceptable usage policy.
Customer agrees that Farihost may report conduct believed to violate applicable law to appropriate authorities and provide information in response to requests from law enforcement, regulatory agencies, or valid civil actions.
Customer agrees to maintain a current copy of all content hosted by Farihost, notwithstanding any agreement by Farihost to provide backup services.
During any service term, Customer may request up to one free restore for any reason. Additional restore requests may be subject to a one-time fee.
Upgrades and other changes in Farihost’s network, including changes to software, hardware, and service providers, may affect the display or operation of Customer’s hosted content or applications. Farihost reserves the right to change its network in its commercially reasonable discretion.
Notices to Farihost shall be given via electronic mail to the email address posted for customer support. Notices to Customer shall be given via electronic mail to the individual listed as the Primary Customer Contact on the order.
Farihost shall not be in default of any obligation under this agreement if failure to perform is due to events beyond Farihost’s control, including power grid failure, Internet failure, natural disaster, war, riot, epidemic, strikes, terrorist activity, or similar events.
The agreement shall be governed by the laws of the State of Virginia and the laws of the United States of America, as applicable.
Each party retains exclusive ownership and rights in its trademarks, service marks, trade secrets, inventions, copyrights, and other intellectual property. This agreement, together with the Order and AUP, constitutes the complete agreement between the parties regarding its subject matter and supersedes any prior understanding or communication.
All files stored on Farihost’s servers must be legally owned and accompanied by a valid license or copyright. This includes, but is not limited to, MP3, AVI, MIDI, MPG, MPEG, MOV, EXE, and ISO files. Unlicensed or illegal files may be deleted.
Farihost reserves the right to cancel a service at any time. All fees paid in advance of cancellation will be prorated and paid by Farihost if we institute our right of cancellation, except where cancellation results from a violation of our policies.
Farihost may offer promotional rates or special offers. The terms of these promotions may or may not be more favorable than the standard terms and conditions for your services.
Promotional fees may be subject to additional terms and conditions. Different promotional fees and special offers may not be combined. Promotions that include a domain name may not be refundable or covered by the 30-day money-back guarantee.
Material accessible through Farihost’s services may be protected by copyright, trademark, trade secret, or other intellectual property laws. You must not use Farihost or its servers in a way that infringes, violates, dilutes, or misappropriates any such rights.
Customers may not use the Farihost network to circumvent user authentication or security of any host, network, or account. This includes accessing data not intended for you, logging into accounts without authorization, password cracking, probing security weaknesses, or attempting to interfere with or deny service to any user, host, or network.
You are solely responsible for the development, operation, and maintenance of your online store, products, content, and materials. You are responsible for ensuring that your content does not violate third-party rights or applicable law.
You are also responsible for the security of any customer credit card numbers and related customer information you may access through your website. You must keep such information confidential and secure.
You grant Farihost a license to cache the entirety of your website, including third-party content hosted under this agreement, and agree that such caching is not an infringement of your intellectual property rights or any third party’s intellectual property rights.
Farihost shall maintain and control ownership of all IP numbers and addresses assigned to you by Farihost. Farihost reserves the right to change or remove any such IP numbers and addresses.
You agree to pay Farihost prior to the effectiveness of the desired domain name registration. All domain registration fees are non-refundable, in whole or in part, even if your domain name registration is suspended, canceled, or transferred before the end of the current registration term.
Farihost reserves the right to change fees, surcharges, renewal fees, or institute new fees at any time. Your requested domain name will not be registered until payment is received and registration is confirmed.
Domain transfer requests may fail for reasons including no response from the registered name holder or administrative contact, registrar lock status, domain expiration constraints, or other limitations.
Domain registrations are non-refundable. Please do not purchase a domain name until you are certain it is exactly what you would like to buy.
